Terms of Service

■ 1. Introduction

These Terms & Conditions (“Terms”) govern the purchase and use of services and digital products provided by The Soft Voice (“The Soft Voice”, “we”, “us” or “our”).

By purchasing a product, booking a service, accepting a proposal or otherwise engaging The Soft Voice, you (“you”, “your” or “the client”) agree to these Terms together with any applicable proposal, project agreement, product description or licensing terms.

Where project-specific terms differ from these general Terms, the signed project agreement or proposal will take precedence.



■ 2. Services & Products

The Soft Voice provides:

  1. Brand identity design

  2. Custom web design

  3. Brand + web design

  4. Semi-custom website services

  5. Website templates and other digital products

  6. Additional creative services agreed as part of an individual project scope

The exact scope, deliverables, timeline and investment for custom services will be set out in your proposal or project agreement.

Digital products are supplied as described on the relevant product page at the time of purchase.



■ 3. Booking & Payment

Custom projects are confirmed once the required agreement has been accepted and the deposit or payment specified in the proposal has been received.

Unless otherwise agreed in writing, project work will not begin before the required payment has been made.

Any remaining balance must be paid according to the payment schedule set out in the proposal. Final files, website ownership or other completed deliverables may be withheld until the project has been paid in full.

Digital products require full payment at checkout.

Payments already made are non-refundable except where expressly stated in these Terms, the applicable project agreement, or where required by law.



■ 4. Project Timelines

Estimated timelines are provided when a project is booked and are based on both parties keeping to the agreed schedule.

Clients are responsible for providing content, materials, feedback and approvals when requested. Delays in receiving these may move the project timeline or completion date.

If a project becomes significantly delayed or inactive due to the client, The Soft Voice may reschedule the remaining work according to current availability. Where substantial additional work or expedited scheduling is required as a result, additional fees may apply and will be agreed in advance.

The Soft Voice is not responsible for delays caused by events reasonably outside our control, including third-party platform issues, technical failures or force majeure events.



■ 5. Client Responsibilities

You are responsible for providing accurate, complete and legally usable materials required for the project, including copy, photography, logos, brand assets and other content.

You confirm that you own, license or otherwise have permission to use any material supplied to The Soft Voice.

You are also responsible for reviewing project work carefully and providing clear feedback and approvals within the agreed timeframe.

The Soft Voice is not responsible for claims arising from materials supplied by the client without the necessary rights or permissions.

■ 6. Revisions & Scope

Custom projects include the revisions and deliverables described in the applicable proposal or project agreement.

Requests that materially change the approved direction, introduce new deliverables or fall outside the original scope may be quoted separately.

Additional work will not be undertaken without informing you of any additional cost or change to the project timeline.

■ 7. Intellectual Property: Custom Work

Until all outstanding project fees have been paid in full, all rights in the design work and project deliverables remain with The Soft Voice.

Upon full payment, ownership of the final approved custom deliverables created specifically for the client transfers to the client, to the extent those rights are legally transferable.

This includes the final approved brand identity, logo assets and other bespoke design materials included in the agreed project scope.

The following remain the property of The Soft Voice:

  • Unused or rejected concepts and design directions

  • Drafts, explorations and preliminary work

  • Working files and internal project materials unless expressly included in the agreed deliverables

  • Design methods, processes, systems and know-how

  • Pre-existing studio assets or resources not created exclusively for the client

Any third-party materials used within the project, including fonts, photography, software, plugins, platform functionality or licensed assets, remain subject to their original licences and are not transferred to the client by The Soft Voice.

For website projects, the client receives ownership of the bespoke design work created for their project, while any underlying third-party platform, software, code libraries or licensed components remain subject to their respective terms.

The Soft Voice retains the right to display completed work in its portfolio, website, social media, awards submissions and other studio marketing unless confidentiality has been agreed in writing before the project begins.


■ 8. Templates & Digital Products

Website templates and other digital products remain the intellectual property of The Soft Voice.

Purchasing a template grants you a licence to use it. It does not transfer ownership of the underlying design.

Each template purchase is also subject to our separate Template Licence, which forms part of these Terms and sets out permitted use, client use, customisation, redistribution and single-project licensing requirements.

Digital products may not be shared, reproduced, redistributed or resold except where expressly permitted by the applicable licence.

■ 9. Third-Party Platforms & Services

Some projects and products rely on third-party platforms such as Squarespace, Showit, Canva, domain providers, payment processors, email platforms or other software.

Unless explicitly included in your proposal or product description, subscriptions, licences, domains, premium fonts and other third-party costs are not included in The Soft Voice fees.

The Soft Voice is not responsible for changes, downtime, pricing, functionality, policies or technical issues caused by third-party platforms after delivery.

■ 10. Website Performance, SEO & Business Results

We design and build websites with professional care, but cannot guarantee specific commercial outcomes, search rankings, traffic levels, enquiries, sales or revenue.

Where SEO setup is included, it refers to the agreed foundational or on-page work and does not constitute an ongoing SEO service or guarantee of search engine placement.

After handover, the client is responsible for maintaining their website, subscriptions, content and third-party services unless ongoing support has been agreed separately.

■ 11. Cancellation & Refunds

Requests to cancel a custom project must be made in writing.

Deposits and payments for work already scheduled or completed are non-refundable, except where required by applicable law or otherwise stated in the applicable project agreement.

If a project is cancelled after work has begun, the client remains responsible for payment for work completed up to the cancellation date and any other amounts due under the agreed project terms.

Due to the nature of digital products, template and digital-product purchases are generally final once access or delivery has been provided, except where a refund is required by applicable law.

■ 12. Confidentiality & Privacy

Information shared with The Soft Voice in connection with a project will be treated with appropriate confidentiality.

Personal information is collected and processed in accordance with our Privacy Policy.

We may use trusted third-party providers where reasonably necessary to operate the studio, process payments, communicate with clients or deliver services. Their handling of personal data is subject to their own privacy terms and applicable data-protection requirements.

■ 13. Limitation of Liability

To the fullest extent permitted by applicable law, The Soft Voice will not be liable for indirect, incidental, consequential or special losses arising from the use of our services or products.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

The Soft Voice’s total liability arising from a particular service or product will not exceed the amount paid by the client for that service or product, except where such a limitation is prohibited by law.

■ 14. Governing Law & Disputes

These Terms and any dispute arising from them will be governed by the laws of Georgia, without prejudice to any mandatory consumer rights that may apply.

If a disagreement arises, both parties agree to make a reasonable effort to resolve it directly and in good faith before beginning formal proceedings.

■ 15. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, products or legal requirements.

The version in effect at the time of a purchase or confirmed project will apply to that transaction unless a change is required by law or agreed between the parties.
